Terms and Conditions of Use

2. Registration and Eligibility

2.1 Minimum Age

You must be at least 18 years old to use Kunfupay. By registering, you declare under oath that you are of legal age and have the capacity to enter into binding contracts.

2.2 KYC Verification

To comply with global anti-money laundering (AML) regulations, we require identity verification (KYC) at multiple levels. The system operates on progressive tiers based on transaction volume.

Tier 1: Verified email and phone number (withdrawal limit: $500/month)

Tier 2: Official ID document + verification selfie (no limits)

2.3 Geographic Restrictions

Kunfupay does not operate in OFAC-sanctioned countries (U.S.), including but not limited to: North Korea, Iran, Syria, Crimea, Cuba. We reserve the right to suspend accounts from high-risk jurisdictions without prior notice.

3. Intellectual Property and Content

3.1 Your Content, Your Rights

Kunfupay respects and protects your intellectual property. When you upload content (courses, ebooks, memberships), you retain all copyrights. We do not claim ownership of your creative work.

3.2 Limited Use License

By using the platform, you grant us a worldwide, non-exclusive, royalty-free license to store and distribute your content to buyers, display thumbnails and previews on product pages, and process payments and generate invoices on your behalf.

This license automatically terminates when you delete your account or content from the platform.

3.3 Prohibited Content

It is strictly prohibited to sell on Kunfupay:

• Illegal content: CSAM material, drugs, weapons
• Counterfeit products: Pirated software, brand replicas
• Fraudulent schemes: Pyramids, fake courses, pump & dump crypto
• Rights infringement: Unlicensed music, images
• Malicious services: Hacking, phishing, malware

Violation of these policies results in immediate suspension and possible reporting to authorities.

4. Commissions and Payments

4.1 Commission Structure

Kunfupay charges a platform commission on each completed sale. We never charge fixed fees — you only pay for what you sell. The values shown here are for reference as they are subject to negotiation based on transaction volume.

Free Plan: 8% + processing costs (typically 2.5-3.5%)

Processing costs may vary depending on the payment method. The commission is uniform per contract in most cases, except for specific exceptions in countries with complex economic scenarios. Contact sales for more information.

4.2 Withdrawals and Processing Times

You can withdraw funds to different destinations with varying processing times:

Bank account: 1-3 business days (no additional commission above minimum threshold)

Kunfu Card: Instant (generates a virtual card immediately)

Crypto (USDT/USDC): 30 minutes - 2 hours (blockchain network fee)

4.3 Chargebacks and Disputes

If a buyer requests a chargeback or disputes with their bank, Kunfupay will investigate the case following industry-standard protocols. If the chargeback is resolved in favor of the buyer, the amount will be deducted from your available balance.

Creators with chargeback rates exceeding 1.5% may be temporarily suspended until the dispute pattern is resolved.

5. Limitation of Liability

5.1 Service Availability

Kunfupay strives to keep the platform available 99.9% of the time, but we do not guarantee uninterrupted availability. We are not responsible for losses resulting from temporary server outages, third-party failures (Stripe, payment processors, hosting providers), or DDoS attacks and cyberattacks.

5.2 Disclaimer of Implied Warranties

The platform is offered as is (AS IS). We do not guarantee that you will reach a specific level of sales or revenue, that your content will be popular or profitable, or that conversion algorithms will work perfectly in all markets.

5.3 Monetary Liability Limit

In no event shall Kunfupay's total liability to you (for any legal cause, including negligence) exceed the greater of: the total commissions you have paid to Kunfupay in the last 12 months, or $100 (one hundred dollars).

6. Termination and Suspension

6.1 Voluntary Termination

You can close your account at any time from Settings → Security. Withdraw all your funds before closing the account; we are not responsible for balances abandoned after closure.

6.2 Suspension for Non-Compliance

Kunfupay reserves the right to suspend or close your account immediately if:

• We detect fraudulent or money laundering activity
• You sell prohibited content (see section 3.3)
• Your chargeback rate exceeds 1.5%
• You provide false information during KYC

7. Applicable Law and Jurisdiction

7.1 Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States. Kunfu Global, Inc. is a Delaware corporation (File No. 10259941), and any legal dispute will be resolved under the jurisdiction of the Delaware courts or the corresponding federal courts.

7.2 Dispute Resolution

Any dispute arising from these Terms shall be submitted to the courts of the State of Delaware or, alternatively, to binding arbitration under the rules of the American Arbitration Association (AAA). We will attempt to resolve conflicts in good faith before resorting to legal action.

8. Modifications to the Terms

Kunfupay may update these Terms at any time. Material changes will be notified by email with 30 days' notice. Continued use of the platform after notification constitutes acceptance of the new terms.
